1. Eligibility: This $10,000 Giveaway Campaign is open to Australian Citizens who download the Erth Point App and earn Erth Points from participating businesses and/or Gift Cards.

2. For every cumulative spend of AUD$10 where Erth Points are earned, the person who earned the Erth Points will have earned one entry in the Giveaway Campaign. If they earned points from $928.63 worth of spending, they will have earned 92 entries to the Competition.

3. An entry can also be earned by referring the Erth Point App to a new person –

a. The person that referred them, must use the share button and their unique QR or referral code to enable the system to track referrals via the QR Code.
b. This is conditional upon the new referred person spending $10 where Erth Points have been earned.
c. The person that referred them shall receive one entry for every $10 spent by the person that they referred.
d. The referring person can refer as many people as they want to, and they shall receive one entry for every $10 spent by the people they have referred.
e. Example –

• i. The referring person spent $928.63 so they earned 92 entries in the competition
• ii. Person one that they referred spent $658.26, so that person earned 65 entries and the referring person earned another 65 entries.
• iii. Person two that they referred spent $1,478.38 giving themselves and the person that referred them a further 147 entries.
• iv. The person that referred both these people earned 92 entries from their own spending and plus 65 plus 147 taking their total entries to 304 entries.
• v. The referring person can refer as many people as they would like to and will receive one entry for every entry the new referred person receives.

4. Purchased Erth Points do not form part of the entry conditions as money must be spent at a participating business or earned from purchasing Erth Pay Gift cards using the Erth Point App for participating Businesses such as Gift Cards for Coles, Woolworths etc.

5. Anyone can enter unless they are involved in the management of Rewards4Earth Foundation Ltd or RWDMSP Pty Ltd or Erth Raffle Pty Ltd.

6. The Campaign or Giveaway or Competition is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

7. Rewards4Earth Foundation Ltd is a charity registered with ACNC and licenced to undertake the raffle, NSW Art Union Authority Number GOCAU/2391.

8. Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of Rewards4Earth Foundation Ltd as final and binding as it relates to the content of this Raffle.

9. Campaign Period: Entries will be accepted online starting on the 20th of January 2023 at 12:00 am AEST and ending on the 15th of December 2023 at 11:59 pm AEST.

a. All entries must be received by the 15th of December 2023 at 11:59 pm AEST.
b. Draw date: 16th of December 2023.
c. The Winner will be announced on our website on the 17th of December 2023.

10. The $10,000 Prize will be paid in Gift Cards from any business available through the Erth Point App or in Erth Points at the discretion of the winner.

11. How to Enter:

a. Download the Erth Point App from the Google Play or Apple App Store
b. Ensure a Debit/Credit Card is registered in the System, and your details are held in Oracle Corp databases, on Oracle Corp Servers, Using Oracle Corp security which is Bank-grade security.
c. You can nominate your favourite Environmental and/or Community Organisations (ECO) as a beneficiary to also benefit from your spending, if no ECO is nominated then the beneficiary’s Erth Points will be credited to the Rewards4Earth Foundation Ltd to benefit the planet.
d. If You use fraudulent methods or otherwise attempt to circumvent the rules, your entry will be removed from eligibility at the sole discretion of Rewards4Earth Foundation Ltd.

12. Prize: The Winner of the Campaign (the “Winner”) will receive AUD$10,000 worth of Erth Point (value at the date) Gift Cards that are usable at any of the 180+ Merchants such as Coles, Ampol, Harvey Norman or many other businesses.

a. The winner can opt to receive $10,000 worth of Erth Points if they so choose.
b. No cash or other prize substitution shall be permitted except at Rewards4Earth Foundation’s discretion.
c. The prize is non-transferable unless requested in writing by the winner and agreed by Rewards4Earth Foundation Ltd.
d. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner.
e. Acceptance of prize constitutes permission for Rewards4Earth Foundation Ltd, to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law

13. Odds: The odds of winning depend on the number of eligible entries received.

14. Winner Selection and Notification:

a. The Winner will be selected by a random number generator under the supervision of Rewards4Earth Foundation Ltd.
b. Winner will be notified by email within five (5) days following the selection of the Winner.
c. Rewards4Earth Foundation Ltd shall have no liability for the Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information.
d. If the Winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected.
e. Receipt by the Winner of the prize offered in this Campaign is conditional upon compliance with any and all federal, state, and local laws and regulations.
f. ANY VIOLATION OF THESE OFFICIAL RULES BY the WINNER (AT Rewards4Earth Foundation Ltd’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

15. Rights Granted by You: You understand and agree that Rewards4Earth Foundation Ltd, anyone acting on behalf of Rewards4Earth Foundation Ltd, and Rewards4Earth Foundation Ltd, licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Raffle, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

16. Terms & Conditions: Rewards4Earth Foundation Ltd reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Raffle should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Rewards4Earth Foundation Ltd control corrupt or affect the administration, security, fairness, or proper conduct of the Raffle.

a. In such case, Rewards4Earth Foundation Ltd may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Rewards4Earth Foundation Ltd. Rewards4Earth Foundation Ltd reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Raffle or website or violates these Terms & Conditions.
b. Rewards4Earth Foundation Ltd has the right, in its sole discretion, to maintain the integrity of the Raffle, to void entries for any reason, including, but not limited to:

• i. the use of bots, macros, scripts, or other technical means for entering.
• ii. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Raffle may be a violation of criminal and civil laws.

Limitation of Liability: By entering, You agree to release and hold harmless Rewards4Earth Foundation Ltd and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly.
